This application has been filed for modification of the order date 05-10-2023, passed in the connected writ petition.
Dr. N.Mozika, learned DSGI assisted by Ms. S.Rumthao, learned counsel for the applicant, submits that the interim order has impacted the transfer and posting of the medical officers in various Central Armed Police Forces. As such, he prays that the interim order, if any, be limited in its operation only to the writ petitioners who are before this Court.
Mr. S.Thapa, learned counsel for the respondents, though appearing without instructions, prays that he may be allowed some time to seek instructions and file affidavit. Prayer is allowed.
This Court has noted the interim order dated 05-10-2023 which is continuing till date. A perusal of the same does not anywhere show that the impugned policy dated 18-09-2023, which appears at Annexure-L of the writ petition has been suspended or stayed in any manner. In fact, the only order operating is with regard to the status quo that is to be maintained until the next date. In this view of the matter, status quo would mean only status quo as to the movement of the writ petitioners in the on-going matter.
In that view of the matter, this Misc. application seems unnecessary. Same is disposed of.
