Heard the Ld. Counsel for the Appellant. The Appellant bank is aggrieved by the order of the Ld. Presiding Officer in O.A. No 242/1997 on the files of the Debts Recovery Tribunal, Ahmedabad( D.R.T).

The Appeal is filed in the year 2006 and has been pending for quite some time. The Ld. Counsel for the Appellant was not present and no Vakaltnama was filed by the Counsel who was present on getting telephonic information hence, the Appeal was dismissed by this Tribunal on 07.02.2017.

The Respondent is a company that has gone into the liquidation and is represented by the Official Liquidator. The objection has been filed. After having heard both sides, I find that there is no delay in filing the application for restoration, and the reason stated for filing the application and no appearance on the part of the Counsel is also explained. Being an Appeal of the year 2006, the application can only be allowed by putting the Appellant to terms.

Hence, the application for restoration is allowed on payment of cost ₹ 10,000/- to the D.R.T., Bar Association within a period of two weeks for the purchase of books and periodicals.

Post on 06.02.2023 before the Registrar for reporting compliance.
