Judgment
Mohammed Nias. C.P.,J
This writ petition is filed with the following prayers:
“i) Declare that the petitioner is entitled to undertake maintenance of the pond by removing mud and earth and constructing bund and also increasing the area of the same, in item No.2 property converted by Exhibit P1, for generating more water in the pond for agricultural purposes and for running agricultural-animal farm in the properties of the petitioner and her family;
ii) issue a writ of mandamus or any other appropriate writ, order or direction to the respondents, not to prevent the petitioner from undertaking maintenance of the pond by removing mud and earth and constructing bund and also increasing the area of the same, in item No.2 property covered by Exhibit P1, for generating more water in the pond for agricultural purposes and for running agricultural – animal farm in the properties and her family;
iii) direct the respondents to grant permission, if necessary to the petitioner to undertake maintenance of the pond by removing mud and earth and constructing bund and also increasing the area of the same, in item No.2 property covered by Exhibit P1, for generating more water in the pond for agricultural purposes and for running agricultural – animal farm in the properties of the petitioner and her family;
iv) Grant such other reliefs as this Hon'ble Court shall deem fit in the circumstances.”
When the matter is taken up, the learned Government Pleader submits that the property in question is included in the data bank. This is recorded. The petitioner will be free to seek appropriate permissions under the Kerala conservation of Paddy Land Act, if so advised. The blanket prayers as sought for cannot be granted. Reserving such liberty, the writ petition is closed.
