Judgment
The Writ Petition is filed seeking the following reliefs:
a) Issue a Writ of Mandamus or any other appropriate Writ or Direction commanding the 1st respondent not to proceed against the
petitioner's property without giving him an opportunity to raise his contention.
b) To issue a Writ of Certiorari or any other appropriate writ to the 1 st and 2nd respondents against the petitioner and quash Exhibit P4
and related proceedings of the respondent against the petitioner for alleged recovery of liability by the 3rd respondent and further direct
the respondents not to take any coercive steps against the petitioner as the petitioner is amenable for paying off the liability.
c) To issue a Writ of Mandamus or any other appropriate Writ or Direction, directing the 1st and 2nd respondents to give sufficient time at
least six months, to pay off the amount with respect to the chitty.
d) To pass such other Writ or Order or Direction as this Honourable Court may deem fit in the facts and circumstances of the case.
The learned Standing Counsel submits that the account in respect of the Principal Debtor is already closed.
The Writ Petition is accordingly disposed of.
