Judgment
Heard Shri T. Chutia, learned Counsel for the petitioners namely 1. Shri Umesh Deka 2. Smti Bidyawati Deka and 3. Shri Dimbeswar Deka, who
have filed this application under Section 438 of the Cr.P.C. praying for grant of pre-arrest bail in connection with Letter dated 13.03.2021 to Lot
Gaonburha, No. 2 Bhoralichuk, Dhemaji by one Smti Mousumi Doley regarding settlement of an agreement for sale deed (Land) dated 05.05.2015.
The learned counsel submits that though the petitioners are not aware of registering any case, the police are looking for them based on the said letter.
Shri T.K. Mishra, learned Addl. Public Prosecutor, Assam is directed to obtain instructions as to whether any case has been registered against the
petitioners.
List this case on 17.06.2021.
Shri Chutia, learned counsel for the petitioners prays for some interim protection by submitting that the dispute is essentially of a civil nature.
Considering the above, it is directed that in the event, any case has been registered containing non-bailable offence, in the interim, in case of arrest of
the petitioners, they shall be released on bail in connection with the aforementioned case on furnishing bail bond of Rs. 10,000/- (Rupees Ten
Thousand) each with a surety of like amount subject to the satisfaction of the arresting authority.
The petitioners are directed to appear before the IO on or before 10.06.2021 for recording their statements.
The petitioners are also directed to render full cooperation to the investigation and not to indulge in any activities detrimental to the same.
