1.

Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

2.

The instant bail application under Section 439 Cr.P.C. has been preferred on behalf of the petitioner who is in custody in connection with F.I.R. No.526/2014, registered at Police Station Pilibanga, District Hanumangarh for the offences under Sections 392, 397, 452 and 411 / 34 IPC.

3.

The petitioner is in custody in this case from 15.12.2014.

Admittedly no test identification proceedings were held by the I.O. during investigation. The accused were not named in the FIR and the case of the prosecution as against the present petitioner, co-accused Dadosa @ Vinod and Sandeep @ Sonu appears to be based on incriminating recoveries. Dadosa @ Vinod has been granted bail by this Court. Though the petitioner is implicated in few more criminal cases but he has been granted bail by this Court in three of those cases. Copies of the orders granting bail to the petitioner in other cases are taken on record.

4.

Having regard to the facts and circumstances available on record and looking to the prolonged custody period suffered by the petitioner and so also the fact that co-accused Dadosa @ Vinod has been granted bail by this Court, I am of the opinion that the petitioner deserves to be enlarged on bail.

5.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is directed that the petitioner Umakant @ Robin @ Uma Shanker arrested in connection with the F.I.R. No.526/2014, registered at Police Station Pilibanga, District Hanumangarh shall be released on bail provided he furnishes a personal bond of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
