Judgment
The present petition has been filed under Section 29A of the Arbitration and Conciliation Act, 19961 seeking extension of the mandate of the learned Arbitral Tribunal for a further period of three months.
The learned Arbitral Tribunal was constituted by this Court vide order dated 03.11.2016.
It is to be noted that the mandate of the learned Tribunal had already extended by this court vide orders dated 10.09.2024, 22.09.2025 and 20.03.2026 and is presently due to expire on 19.09.2026.
Learned Counsel for the Petitioner submits that the arbitral proceedings have substantially concluded and reserved for pronouncement of the award.
Issue notice.
Notice is accepted by Ms. Suruchi Thapar, learned Counsel appearing for the Respondent.
Learned counsel for the Respondent submits that she has no objection against the extension of the mandate.
In view of the stage at which the arbitral proceedings presently stand and the fact that the matter is already listed for pronouncement of the award, this Court is satisfied that sufficient cause is made out for extending the mandate of the learned Arbitral Tribunal.
Accordingly, the mandate of the learned Arbitral Tribunal is extended for a further period of three months with effect from 19.09.2026 to enable the learned Tribunal to conclude the proceedings and render the award.
The learned Arbitral Tribunal shall endeavour to render the Award within the extended period.
The present petition stands disposed of in the above terms.
