Heard. The delay in filing the review petition is condoned and the application is disposed of.

The review Petitioner is the writ Petitioner. The writ petition was filed praying for a direction to count the ad hoc service rendered by the Petitioner for the purpose of increments and pension. It appears, inadvertently the writ petition was disposed of with a direction to count the training period for the purpose of service benefits. The case of the writ Petitioner is for counting the ad hoc service for the purpose of increments and pension. Therefore, the judgment dated 14.7.2010 in CWP No. 3843 of 2010 is recalled and the review petition is allowed, as above.

The grievance of the Petitioner is that the ad hoc service rendered by him is not counted for the purpose of increments and pension. That issue is to be looked into in the light of the judgment in Sita Ram v. State of H.P. rendered in LPA 36 of 2010. There will be a direction to the second Respondent to look into the matter in the light of the decision, referred to above and take appropriate action within a period of three months from the date of production of a copy of this judgment along with a copy of the writ petition and the copy of the judgment, referred to above, by the Petitioner before the second Respondent.

The writ petition is disposed of, so also the pending applications, if any.

The Registry is directed to place a copy of this judgment in the file of CWP No. 3843 of 2010.
