Judgment
Tarlok Singh Chauhan, J
On 13.04.2018, the erstwhile H. P. State Administrative Tribunal disposed of TA No. 692 of 2015 filed by the petitioner by passing the following orders:-
"8.Consequently, the transferred application is allowed and the respondents are directed to hold DPC and consider the case of the applicant for promotion to the post of Horticulture Development Officer with effect from 24.06.1998 with all consequential benefits within two months from the date of production of certified copy of this order."
Even though the respondents did even convene the DPC and found the petitioner to be eligible for being promoted as Horticulture Development Officer (Class-I, Gazetted) but the said promotion was granted only notionally to him and it was further observed that this promotion would not confer any right on the petitioner for his continuation, regularization or seniority in the common cadre of the H.P. Horticulture (Class -I, Gazetted) Services. This is clearly in the teeth of the observations made in para-8 (supra).
Accordingly, we deem it proper to register this petition as Contempt petition. Ordered Accordingly.

Notice confined to respondents No. 1 and 2. Mr. Vinod Thakur, learned Additional Advocate General, appears and waives service of notice on behalf of the respondents. Reply be filed within four weeks. Respondents No. 1 and 2 to show cause why they have not been prosecuted and punished for having deliberately and willfully disobeying the orders passed by the erstwhile H.P. State Administrative Tribunal on 13.04.2018.
