Udal Singh vs Cane and Sugar Commissioner and Another

Sudhanshu Dhulia, J.—Heard Mr. Manoj Tiwari, Senior Advocate, assisted by Mr. Bhagwat Mehra, Advocate for the Petitioner and Mr. N.P. Sah, Standing Counsel for the State of Uttarakhand.

The Petitioner is working in the Sugarcane Department as Cane Supervisor. By means of this writ petition he prays that the seniority list in the department be revised. The Petitioner also states that he has moved a representation before the Cane Commissioner, Uttarakhand for the purposes, which has not been decided.

Learned Standing Counsel has made an objection that the said representation has not been made by the Petitioner in his personal capacity but in the capacity of Provincial General Secretary, Sugarcane Supervisor Association, Uttarakhand.

The Petitioner says that the representation was not filed by the General Secretary, but the same was filed by the Petitioner being the General Secretary of the Sugarcane Supervisor Association.

Be that as it may, the Petitioner is also permitted to move a fresh representation in his personal capacity before the Cane Commissioner, Uttarakhand, which shall be decided in accordance with law as expeditiously as possible.

With these observations, the writ petition is disposed of.

No order as to costs.
