Judgment
B.S. Verma, J.—Heard Mr. Sharad Sharma, Senior Advocate, assisted by Mr. Kovid Bhatt, Advocate for the petitioner and Mr. V.B.S. Negi, learned Asst. S.G. for the respondents and perused the record.
By means of this petition, under Article 226 of the Constitution of India, the petitioner has sought a writ in the nature of certiorari for quashing the impugned order dated 26-05-2010, issued by respondent No. 2 (Annexure No. 1, to the writ petition).
The grievance of the petitioner is that he is working on the post of J.T.O. at Kashipur and at the fag end of his service career, he is being transferred from Kashipur to Srinagar, Pauri Garhwal, against the provision of B.S.N.L. Employee Transfer Policy.
During the course of arguments, the learned Counsel for the petitioner has urged that the petitioner has moved a representation (Annexure No. 2 to the writ petition) before the C.G.M. Telecom, Uttarakhand Telecom Circle, Dehradun (respondent No. 1), for redressal of his grievance, but the same is still pending. Hence, the respondent No. 1 be directed to decide the same by a speaking order and the writ petition may be disposed of today. Prayer is innocuous.
Without entering into the merit of the case, the respondent No. 1 is directed to decide the representation of the petitioner and pass a speaking and reasoned order thereon, within a period of four weeks from the date of production of certified copy of this order.
With the above direction, the writ petition is disposed of finally.
