Revisionist has assailed order dated 09.09.2025 of the learned Principal Judge, Family Courts, New Delhi whereby, the revisionist was directed to pay monthly interim maintenance of Rs. 30,000/- to the present respondent.

Today is the first effective date, since all through the matter could not reach till even late evening for hearing.

Learned counsel for revisionist assails the impugned order mainly on the ground that the learned Family Court failed to adjust the maintenance awarded in the other proceedings. It is contended by learned counsel for revisionist that prior to the proceedings that led to the impugned order, the present respondent had filed proceedings under The Protection of Women from Domestic Violence Act in which the learned Magistrate awarded monthly maintenance at the rate of Rs.13,000/-. According to the revisionist, while passing the impugned order, the learned Family Court ought to have adjusted that amount of Rs. 13,000/-, which has not been done, so it is a case of unjust enrichment.

Learned counsel for respondent appearing with respondent in person on advance intimation accepts notice and on instructions in all fairness concedes to the argument advanced on behalf of the revisionist. Learned counsel for respondent submits that in the interest of expeditious disposal, this petition may be disposed of with consent and the impugned order be modified to the extent that the interim maintenance be awarded at the rate of Rs. 17,000/- per month so far as the proceedings pending before the Family Court are concerned.

Accordingly, with consent of both sides, the impugned order is modified to the extent that the revisionist shall pay monthly interim maintenance to the present respondent at the rate of Rs. 17,000/- from the date of filing the maintenance petition till its disposal. However, it is made clear that the amount of Rs. 13,000/- towards monthly maintenance fixed in the proceedings under The Protection of Women from Domestic Violence Act shall remain applicable as it is.

The petition and the accompanying applications stand disposed of.
