Judgment
V. Narasingh, J
Heard learned counsel for the Petitioner and learned counsel for the State.
The Petitioner is CCL in J.G.R Case No.27/27 of 2023 pending in the Court of learned Principal Magistrate, Juvenile Justice Board, Sambalpur, arising out of PR of EI and EB Unit-II(ND), Sambalpur Case No.21 of 2023-24 for commission of the offence under Section 20(b)(ii)(C) the N.D.P.S Act.
Being aggrieved by the rejection of his application for bail by the learned P.M., J.J.B., Sambalpur, by order dated 07.04.2023 in the aforementioned case, the present BLAPL has been filed.
It is submitted by the learned counsel that since the co-accused has been released on bail by this Court by order dated 08.06.2023 in BLAPL No.6071 of 2023, the Petitioner a JCC may be released on bail.
It is stated by the learned counsel that the Petitioner is in conflict with law for the first time.
Learned counsel for the State has placed the relevant recitals in the Case Diary.
Considering the same, this Court sets aside the impugned order and directs the Petitioner to be released on bail on such terms to be fixed by the Juvenile Justice Board, Sambalpur in terms of the stipulation of Juvenile Justice (Care & Protection of Child) Act.
The CRLREV accordingly stands disposed of.
Urgent certified copy of this order be granted in course of the day.
