This matter is taken up by virtual mode.

This is an application U/S. 439 Cr. P.C.

Heard learned counsel for the petitioner and learned Additional Government Advocate for the State.

The petitioner is implicated in the offences punishable under Sections 379/ 413/ 120(B)/ 420/ 467/ 468/471/473/34 IPC and other allied offences.

Considered the materials placed by learned counsel for the parties including the impugned order passed by the learned lower court.

Other co-accused persons similarly circumstanced to the present petitioner are stated to have been released on bail in the meantime.

There are stated to be 18 criminal antecedents against the present petitioner.

Regard being had to the facts and submissions, factum of permanent residence of the petitioner and the stage of the proceeding, it is directed that

the petitioner shall be released on bail by the learned S.D.J.M., Talcher, in G.R. Case No.1196 of 2019 on such terms and conditions as deemed just

and proper in the facts and circumstances of the case including the following conditions :-

(I) The petitioner shall appear before the I.I.C., Talcher Police Station once in a fortnight till conclusion of trial in the present case and on such appearance before the

I.O., he shall account for his past conduct during the last fifteen (15) days before the I.O.

(II) He shall not involve himself in similar or any other offence during currency of this order.

The BLAPL is accordingly disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order

available in the High Court’s website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide

Court’s Notice No.4587 dated 25th March, 2020 as modified by Court’s Notice No.4798 dated 15th April, 2021.
