Heard Mrs. S. Deb (Gupta), learned counsel appearing for the TSECL. Also heard Mr. B. Majumder, learned counsel appearing for the claimant-respondents.

Mrs. Deb (Gupta) learned counsel has submitted that Mr. A. Gan Chaudhury, learned counsel representing the United Insurance Company Ltd., had informed her that they have paid the entire amount as awarded by the Commissioner to the claimant-respondents of the case. She has further submitted that the corporation had preferred the instant appeal only to shift their liability upon the insurance company and she has already been informed by the counsel for the insurance company that insurance company has already paid the amount to the claimants.

Mr. Majumder, learned counsel for the claimant-respondents also admitted this fact that the claimants had received the entire amount as awarded by the commissioner, but from whom they received the said amount is not known to him.

In view of the submission made by Mrs. S. Deb (Gupta), learned counsel for the TSECL that the insurance company had paid the amount to the claimant-respondents and the admission of the same by Mr. Majumder, learned counsel for the claimant-respondents, the present appeal is disposed of. However, if any party is aggrieved of such disposal of the case, they may approach the Court within a period of 1(one) month from today. It is also clarified that if any amount is deposited in the Registry of this Court by the TSECL, that may be allowed to be withdrawn by the corporation.

In the aforesaid terms, the instant appeal stands disposed.
