The present writ petition has been filed under Article 226 of the Constitution of I ndia to quash the impugned orders dated 15.01.2018, 15.09.2021 (Annexure No.2 to the writ petition) and 16.10.2024 (Annexure No.8 to the writ petition), passed by the District Magistrate, Tehri Garhwal under Rule 3 read with Rule 57 of the Uttarakhand Mineral (Prevention of Illegal Mining, Transportation and Storage) Rules, 2021.
Heard Mr. Dharm endra Barthwal, learned counsel for the petitioner and Mr. Yogesh Tiwari, learned Standing Counsel for the State and Mr. S.S. Chauhan, learned counsel for the respondent no.3.
Mr. Dharm endra Barthwal, Advocate has requested to perm it the petitioner to withdraw the present writ petition granting liberty to the petitioner to file an appeal against the said orders under Rule 15 of the Uttarakhand Mineral (Prevention of Illegal Mining, Transportation and Storage) Rules, 2021.
The said request has not been opposed by learned counsel for the respondents.
The present writ petition is dismissed as withdrawn granting liberty to the petitioner to file an appeal, as prayed, but in accordance with law.
