Heard Mr. R.K. Rout, learned counsel for the Petitioner and Ms. S. Mishra, learned Additional Standing Counsel.
This is an application under Section 439 Cr.P.C. for grant of bail to the Petitioner Trifala Swain in connection with Gop P.S. Case No.67 of 2021 corresponding to S.T. Case No.8 of 2021 (G.R. Case No.107 of 2021) pending in the court of learned Additional Sessions Judge, Nimapara for alleged commission of offence under Sections 498-A/294/307/506/354/34 of the Indian Penal Code.
It is submitted that the Petitioner, who is a lady aged about 63 years and mother-in-law of the victim is inside custody since 27th February 2021, except two weeks when she was released on interim bail. It is further submitted that in the meantime the trial has commenced and 11 witnesses have been examined.
After hearing learned State counsel and considering the period of detention of the Petitioner inside custody as well as the proviso to Section 437 Cr.P.C., it is directed to release the present Petitioner on bail in the aforesaid case on such terms and conditions to be fixed by the learned court in seisin over the matter.
The BLAPL is accordingly disposed of.
An urgent certified copy of this order be issued as per rules.
