Mr. Nayak, learned advocate appears on behalf of petitioners and submits, the private family deity has been declared to be public deity and Non-Hereditary Trust Board approved by the Government, as appearing from impugned communication dated 4th March, 2023 made by the Commissioner. This was without the Commissioner having dealt with his clients’ objection dated 25th May, 2022.

Mr. Rout, learned advocate, Additional Standing Counsel appears on behalf of State and Mr. Nath, learned advocate, for the Commissioner.

On query from Court Mr. Nath submits, he has to take instruction on whether the objection dated 25th May, 2022 was disposed of prior to sending proposal for approval by the Government on formation of Non-Hereditary Trust Board. He prays for listing next week. Private opposite parties may be noticed later, after we hear the Commissioner.

Mr. Nayak prays for leave to correct particulars in the genealogical table under annexure-3. Leave is granted to make the correction in Court, to be counter signed by Court Master. Corrected copy of annexure-3 be circulated to learned advocates for State and the Commissioner.

List on 4th April, 2023. Impugned communication will remain stayed till next date of hearing.
