Totaram vs State of Rajasthan

Superintendent, District Jail, Alwar has forwarded the parole writ petition of convict/petitioner, Totaram S/o. Budharam for grant of parole, which is addressed to Deputy Registrar(Judicial), Rajasthan High Court, Jaipur Bench. It appears that parole application has been sent directly to Hon''ble The Chief Justice, Rajasthan High Court, Bench Jaipur by Superintendent, District Jail, Alwar vide its letter dated 12th September, 2012. Ordinarily as and when, an application is filed by a convict for grant of parole, then the same has to be dealt with in accordance with the provisions of Rajasthan Prisoners Release On Parole Rules, 1958 by the Parole Advisory Committee and the application is not entertained directly by this Court. The application has to be examined on merits by concerned District Parole Advisory Committee first and in case an adverse order is passed by concerned District Parole Advisory Committee, the convict has a right to approach this Court against order of Parole Committee.

In these circumstances, we dispose off the writ petition with direction to Superintendent, District Jail, Alwar to forward the application of the convict/petitioner Totaram to concerned District Parole Advisory Committee for its consideration in accordance with law. A copy of this order be sent for compliance to Superintendent, District Jail, Alwar and for information to convict/petitioner, Totaram.
