Appellant filed a suit for permanent injunction, which is registered as Original Suit No. 301 of 2021 in the Court of Civil Judge (S.D.), Haridwar.
Appellant had also filed a temporary injunction application praying that defendants be directed to maintain status quo qua suit property, during
pendency of the suit. The said application has been rejected by learned Trial Court vide order dated 20.11.2021, which is impugned in this appeal.
Heard learned counsel for the parties and perused the record.
Learned Civil Judge (S.D.), Haridwar has considered and discussed all relevant aspects and has come to the conclusion that no prima facie case is
made out for grant of temporary injunction.
Injunction is a discretionary relief and learned court below has exercised its discretion in a judicious manner, therefore, this Court does not find any
reason to interfere with the order impugned in this appeal.
Accordingly, appeal is dismissed. No order as to costs.
