Judgment
Petitioner is a Graduate in Economics with 70% physical disability. Initially, when the results were published, it was shown that she had failed in the
examination. In those circumstances, the petitioner submits that though she could not register her application because the mark list to the effect that
she passed the examination was not available. It is sated that the last date for submission of application online for admission to Post Graduate Degree
course under the 3rd respondent was on 25.05.2019. Petitioner got her marks corrected and a consolidated marks from grade card was issued by the
University only on 27.05.2019. Even before that the petitioner had filed a writ petition before this Court in W.P.(C).No.13869 of 2019 for a direction to
the 3rd respondent to accept her application and process the same for admission to M.A. (Economics) without insisting marks. Pending that writ
petition, petitioner got the grade card on 27.05.2019.
Learned Government Pleader on instructions submits that one seat for physical handicapped candidate is available under the 3rd respondent for
admission to M.A. (Economics). It is also pointed out that there is no other applicant under that category. It is also pointed out that in the absence of
an applicant under physically handicapped category, the said seat is to be reverted to general category.
However, since the seat is not already reverted and the petitioner is a physical handicapped candidate with 70% disability who got her marks and
grade card subsequent to the last date of application, there shall be a direction to the 3rd respondent to accept her application and to consider the same
for admission in accordance with her eligibility against the unfilled seat reserved for physically handicapped. It is made clear that admission shall not
be denied for want of application before the last date. This shall be done within a period of one week from the date of receipt of a copy of the
judgment.
