PARTIES have filed joint application under Order XXIII Rule 3 CPC. It is stated that parties have arrived at an amicable settlement and terms and conditions of settlement are recorded in the application which is duly signed by both the complainants as also Mr. R.K. Anand, Authorised Representative of the opposite party.

WE have perused the application under Order XXIII Rule 3 CPC containing terms of settlement and the accompanying affidavits of Shri R.K. Anand, Authorised Representative of the opposite party and the complainants. Learned counsel for the parties have assured that the compromise has been arrived at amicably without any influence or pressure on either of the parties. Learned counsel for the parties have stated that since the parties have settled the dispute resulting in new agreement, the complainants seek to withdraw the complaint.

IN view of the above, complaint is dismissed as settled/withdrawn. It is, however, made clear that the parties shall be bound by the terms and conditions contained in the application (Ext. C -1).
