S.K. Jain, J.—Vide application u/s 125, Criminal Procedure Code, Smt. Sumeti Devi and her daughter Baby Rani alias Nishi claimed maintenance from Tilak Kumar at the rate of Rs. 800/- per month

2.

I have beard the learned counsel for the parties. Admittedly, the income of the husband Tilak Kumar was Rs. 1050/- per month, out of which under the Orders of the Court he was liable to pay Ra. 300/-P.M. as maintenance to his widowed mother. The balance amount of Rs. 750/'' is required to feed Tilak Kumar himself, Sumeti Devi, Baby Rani and another infant child of the parties. The grant of Rs. 250/- per month to Sumeti Devi and Rs. 150/- per month to Baby Rani is no a little higher side. Under the circumstances, I reduce the amount of ad interim maintenance granted to Sumeti Devi from Rs. 250/-. p.m. to Rs. 200/- per month while the grant of Rs. 150/-to Baby Rani ii kept intact. Thus the total amount of maintenance will be Rs. 350/- per month. The order of the learned Judicial Magistrate is modified as stated above and this petition id disposed of accordingly.
