1.

Petitioners are the appellants in A.S. No.89/2023 of the District Court, Palakkad. They preferred Exts.P3 and P4 applications on 06.02.2024. The short grievance is that, the appeal now stands posted for judgment, even without considering the said applications and affording an opportunity of hearing to the parties. This Court obtained telephonic instructions from the District Judge concerned. The information received is to the effect that Exts.P3 and P4 applications were not considered earlier and that the same will be considered today (14.03.2024) along with the appeal.

2.

In the above referred facts, there will be a direction to the leaned District Judge to consider and pass orders in Exts.P3 and P4 applications first and to afford a breathing time to the petitioners, or for that matter, to the respondents to carry further proceedings, if any, based on the outcome of Exts.P3 and P4. Thereafter, the appeal be heard after affording an opportunity of hearing for both sides.

This Original Petition is disposed of, as above.
