Heard learned counsel for the appellants. We have also gone through the judgment of the learned Single Judge as well as the material placed on record. The respondent-writ petitioner approached the appellants for construction of a building, which came to be rejected by Exhibit P2 order. This was the subject matter of challenge before the learned Single Judge on the ground that without implementing the master plan for the last 15 years, building permits are refused without any rhyme or reason.

The learned Single Judge, after referring to earlier judgments of this Court reported in Nasar Vs. Malappuram Municipality, and also Padmini v. State of Kerala ( 1999(2) KLT 465) was justified in saying, placing reliance on a master plan, which never saw the light of the day, the Municipality cannot reject the applications for sanction of permit and plan.

We do not find any good ground to interfere with the judgment of the learned Single Judge. Accordingly, the Writ Appeal is dismissed.
