This review petition is submitted by the Devaswom against the order directing to pay an amount of Rs. 2 Lakh to the Commissioner appointed. It is submitted that the litigation was started based on the dispute between two fractions of people in one Kara, and not with Devaswom. As such, it is not justified in ordering the Devaswom to pay an amount of Rs.2 Lakh by way of Batta to the Commissioner appointed.

The Interlocutory Application was maintained by the appellant/petitioner and hence the primary liability to pay the Batta is on the petitioner. There is also some dispute with respect to the quantum of the amount fixed by this Court and it is submitted that they are prepared to pay the said amount in two installments. The review petition will stand allowed by directing the petitioner to pay an amount of Rs.1,00,000/- (Rupees One Lakh only) on or before 30.08.2022 and the balance Rs.1,00,000/- (Rupees One Lakh only) on or before 30.09.2022. The Receiver shall report to this Court regarding the payment of Batta.
