This petition is filed under Section 482 of Cr.P.C. seeking for quashment of C.C.No.279 of 2015 registered against the petitioners on the file of the learned Judicial Magistrate No.IV, Madurai.
It is submitted by learned counsel for the petitioners that the first petitioner, who is practising in the Hon’ble Supreme Court, has been roped in falsely in C.C.No.279 of 2015, for the offence under Sections 143, 341 and 188 of I.P.C., when he has come to Madurai and went to the Police Station after coming to know about the custodial death of a known person and demand the respondent Police to register a case.
Learned Government Advocate (Criminal Side) has taken notice for the State and requested time to file a detailed counter. It is submitted by learned Government Advocate (Criminal Side) that out of ten accused persons, Accused No.2 reportedly died and Non-Bailable Warrants are stated to have been pending on Accused Nos.3 and 10.
Learned counsel for the petitioners requested time to file translated copies of the relevant material documents. At the request of the learned counsel for the petitioners, he is permitted to file additional affidavit.
List on 18.09.2023. Until then, the presence of the petitioner before the trial Court is dispensed with.
