In this application under Section 482 Cr.P.C., the petitioner has prayed for quashing of the order dated 24.01.2017 passed by the learned AdditionalÂ

Sessions Judge, Balugaon P.S. No. 75(5) of 2005 Â Â corresponding to G.R. Case No. 207 (B) of 2005, now pending in the court of learned

J.M.F.C., Chilika wherein the case has been split up against the accused persons, who were absent namely, (1) Dhruba   Behera, (2) Satyabadi

Behera, (3) Narayan Swain, (4) Akhaya Behera, (5) Daka Behera, (6) Thira Swain (petitioner) and (7) Purna Chandra Behera and police papers

have been supplied to other accused persons, namely, (1) Bhagaban Swain, (2) Manoj Kumar Swain, (3) Kishore Das, (4) Narayan Bhatta, (5)

Sukanta Kumar Behera, (6) Rabindra Behera, (7) Jitendra Kumar Behera, (8) Ganesh Swain, (9) Manas Kumar Majhi, (10) Halu Behera, (11) Sanat

Bhatta, (12) Bhagabat Behera, (13) Artatrana Swain who are present and had been filed Hazira.

Mr. Sanjib Kumar Bhanjadeo, learned counsel for the petitioner submits that even though the case has been split up, the original split up case has not

yet been committed and is pending before the learned J.M.F.C., Chilika for commitment.

Considering the said submission, Registry is directed to call for a report from the learned J.M.F.C., Chilika regarding status of G.R. Case No. 207 (A)

of 2005 and G.R. Case No. 207 (B) of 2005.

List this matter on 03.03.2022.

The petitioners shall not be arrested in this case till 20.02.2022.

Urgent certified copy of this order be granted on proper application.
