The petitioner had filed the present bail petition under Section 439 CrPC on 20th February, 2020, through Mr. Gobind Korla, Advocate, and it was registered as Cr.MP(M) No. 430 of 2020 and listed in Court on 6th March, 2020, on which date this Court had issued notice to the respondent/State which were duly accepted on its behalf.
After that, due to Covid-19 pandemic, the matter could not be taken on the date fixed and was listed before the Court on 26th August, 2020, when Mr. Gobind Korla, Advocate, made a submission that he is not getting any instructions from his client and such he wanted to withdraw the petition itself. Given above, the Court had requested Mr. Arjun Lall, Advocate, to conduct this case on behalf of the petitioner, as a Legal Aid Counsel.
Today, when the case was taken up for hearing, Ms. Kalyani Acharya, Research Assistant, posted in this Court, has pointed out that the petitioner had earlier filed a similar bail petition arising out of the same FIR in which this Court had already granted bail vide order dated 24th June, 2020, passed in Cr.MP(M) No. 411 of 2020. Printout of the order dated 24th June, 2020, passed in Cr.MP(M) No. 411 of 2020 is taken on record. This fact gets corroboration even after a careful reading of the status report.
Given above, this petition is not maintainable and is closed as such.
