Judgment
ORDER
This order has arisen out of the Withdrawal Memo filed under Section 12 A of IBC 2016 by the Interim Resolution Professional in IBA/42/KOB/2019.
The Corporate Insolvency Resolution Process was initiated against the Corporate Debtor M/s.Trivandrum Specialists Hospital Pvt Ltd, Thiruvananthapuram vide order dated 19.12.2019 of this Tribunal and the Shri Renahan Vamakesan was appointed as IRP.
The IRP has immediately proceeded to carry out the necessary functions and responsibilities stipulated by the Code.
Now vide the above Memo of Withdrawal, the Interim Resolution Professional stated that the Operational Creditor has settled the dispute with the Corporate Debtor and he received the Form FA and settlement agreements duly signed for withdrawal of CIRP under Section 12 of IBC 2016 and under Regulation 30A of CIRP Regulation 2016.
In view of the settlement of the matter between the parties and as the Operational Creditor has submitted the Form FA on 30.12.2019 to the IRP for withdrawal of the CIRP process in the said IBA/42/KOB/2019, we accordingly, approve the application filed by the Operational Creditor through IRP and the IBA/42/KOB/2019 stands disposed of.
