CMP No. 1160 of 2011:

An application under Order 1 Rule 10 read with Order 22 Rule 10, 10-A and Section 151 CPC has been moved on behalf of the proposed legal representatives of deceased respondent No.1, late Shri Mehar Singh, mentioned in para 2 of the application through counsel Mr. Dibender Ghosh, Advocate with a prayer that whereas the name of deceased respondent No.1, late Shri Mehar Singh may be deleted from the array of respondents, his proposed legal representatives as aforesaid may be brought on record. The application is supported by an affidavit and copies of death certificate of late Shri Mehar Singh and legal heirs certificate along with power of attorney have also been annexed therewith. The application is taken on record. It be registered.

Heard. The application, which is duly supported by an affidavit, is allowed in view of the grounds stated therein. Consequently, the name of deceased respondent No.1, Shri Mehar Singh is ordered to be deleted from the array of respondents and in his place the names of his proposed legal representatives as aforesaid are ordered to be substituted to represent his estate as involved in the present appeal. Amended memo of parties be filed during the course of the day. The Registry also to reflect this order in the list of parties in red ink.

It is stated on behalf of the parties that the present appeal is covered under common judgment dated 20th October, 2011, passed by this Court in RFA No. 193 of 2006, along with RFAs No. 194, 196, 198, 199, 204, 205, 207, 208, 209, 211 and 213 of 2006, the State of H.P. and another vs. Shri Ram Krishan and the connected matters. It being so, the present appeal is disposed of in terms of the aforesaid judgment dated 20 October, 2011, in RFA No. 193 of 2006 and the connected matters. Consequently, the present appeal shall stand dismissed.
