Judgment
23.09.2024 : This Appeal has been filed against an Order dated 23.07.2024 passed by the Learned Adjudicating Authority (National Company Law Tribunal, Ahmedabad Bench, Court 2), in I.A. No. 335(AHM)/2023.
The Appellant, the Financial Creditor has challenged the Order and submits that the direction has been issued to pay the fees whereas the Financial Creditor is contesting the payment and the Adjudicating Authority has not decided the entitlement on merits. He, however, candidly admitted that he has not filed the Reply as was directed on 23.07.2024.
The Adjudicating Authority by the Impugned Order has directed the matter to be listed on 23.09.2024 i.e., today, which clearly means that Application I.A. 335/2023 has not yet been finally decided.
Learned Counsel for the Appellant further submits that now 18.10.2024 is the next date fixed in the Application.
In the facts of the present case, ends of justice be served in granting two weeks further time to the Appellant to file the Reply to the I.A. 335/2023 as directed on 23.07.2024 and Adjudicating Authority may consider and decide the Application in accordance with law.
With these observations, the Appeal is disposed of.
