This civil miscellaneous appeal has been filed by the Tamil Nadu State Transport Corporation, Kumabakonam, challenging the award dated 17.10.2014 passed in M.C.O.P.No.1233 of 2013 on the file of the Motor Accidents Claim Tribunal/Special District Court, Thanjavur.

The claimants are the husband and minor child of the deceased Kavitha. The Tribunal has given a finding that on account of the rash and negligent driving of the driver of the bus belonging to the appellant Corporation. The accident in question took place in which the said Kavitha died. The Court below fixed her age as 24 based on the Post-mortem Certificate. It is stated that she was engaged in Tailoring work and was earning a sum of Rs.6,000/- per month. A multiplier of 18 was adopted. The compensation of Rs. 10,17,400/- awarded under various heads cannot be said to be excessive. The Tribunal specifically earmarked a sum of Rs. 7,00,000/- in favour of the minor child and the said sum was directed to be put in bank deposit. The award passed by the Tribunal cannot be faulted at any ground.

The appeal is without any merit. It stands dismissed. No costs.
