Judgment
Satish Kumar Mittal, J.—The petitioner-Mahalaxmi Cooperative Group Housing Society Ltd. has filed the instant petition for quashing of the demand notice No. 5724 dated 8.5.2012 (Annexure P-12) issued by the Estate Officer-II, HUDA, Gurgaon for payment of additional price of Plot No. GH-2, Sector 43, Gurgaon. In pursuance to the notice issued, a short reply has been filed by the Estate Officer-II, Gurgaon stating therein that the aforesaid notice was inadvertently issued for enhanced compensation of Sector 43, Gurgaon to the allottees of the Group Housing Societies, the land for which was acquired in the year 1993 and was allotted during the year 1998. It has been stated that the enhancement was in respect of the area which was acquired in the year 2000 and not which was acquired in the year 1993 and the said notice has been withdrawn. In view of the said stand taken in the written statement, this petition has been rendered infructuous. Disposed of as having become infructuous.
