ORDER

The Comp App (AT) (CH) (Ins) No.635/2025, has been preferred by the Appellant, being aggrieved against the impugned order dated 17.09.2025, that was passed by the Learned NCLT, Bengaluru Bench in IA No.186/2022, as preferred in CP(IB) No.48/BB/2018.

The Company Appeal is accompanied with a Condone Delay Application, being IA No.1766/2025, where the Appellant has sought a condonation of 36 days of delay that, has chanced in preferring the Appeal. The facts of the case which has been brought on record by the Appellant in the pleadings raised in the Delay Condonation Application, are that they were in receipt of the copy of the order or at least had the knowledge of the same, having provided the same to their Counsel on 24.09.2025, and even then, the Company Appeal was preferred at a much belated stage by filing the same before the Registry only on 22.11.2025. On a simpliciter determination of the limitation from the date of knowledge itself, the Company Appeal would be still be barred by limitation and would not be falling within the condonable period as contemplated under the proviso to Sub-Section (2) of Section 61 of the I & B Code, 2016.

Owing to the aforesaid exclusive fact that the Company Appeal apparently suffers from the vices of delay, the Delay Condonation Application, being IA No.1766/2025, would stand rejected, and as a consequences thereto, the Comp App (AT) (CH) (Ins) No.635/2025, too would stand dismissed. All pending interlocutory applications would stand closed.
