This appeal is by the KSRTC challenging the quantum of compensation awarded by the Civil Judge (Sr.Dn.) and MACT, Harihar in M.V.C.No. 724/2008.

Claimant has sustained injuries in the accident occurred on 16.1.2008 due to the negligence of the driver of the KSRTC bus bearing No. KA 37 F 193 near Haralahalli village. Claimant has sustained fracture of 7 ribs on left and right side of haemophoresic and also fracture of the middle third right clavicle and also fracture of the lateral aspect of 4th rib. The Tribunal, taking the disability at 11.5% to the whole body, has awarded a total compensation of Rs. 1,54.000/- under the following heads:

Medical expenses

Rs. 18,620/-

Loss of income during laid up period

Rs. 9,000/-

Fain and suffering

Rs. 30,000/-

Medical attendant charges

Rs. 6,000/-

Food and Nutrition charges

Rs. 6,000/-

Transportation charges

Rs. 2.000/-

Loss of amenities

Rs. 20,000/-

Loss of future income due to Disability

Rs. 62,100/-

I do not find any exaggeration in the quantum of compensation awarded. Hence, appeal is dismissed being devoid of merits.
