ORDER
This appeal is filed by the appellant against the interim order passed by the learned Presiding Officer, DRT, Madurai in IA 3748/2024 in SA 426/2024 on 28.11.2024.
By the said order, learned Presiding Officer, DRT, Madurai, granted Ad-interim stay subject to the respondent paying 50% of the entire claim amount of Rs.6,88,81,485.78p. in 4 equal instalments. Aggrieved against this order, the present appeal is filed.
Learned counsel for the respondent submitted that as per the conditional order passed, entire amount had been paid apart from payment of balance amount claimed in the sale notice. He further submitted that the Bank has further claimed a sum of Rs.11 lakhs to be paid as legal expenses, charges etc.
Be that as it may, this appeal is filed only against the interim order passed by the learned Presiding Officer, DRT, Madurai and therefore, this Tribunal is of the view that the appeal can be disposed by giving a direction to the learned Presiding Officer, DRT, Madurai to dispose the SA 426/2024 on merits and in accordance with law. By taking into consideration that the respondent/ claimant made payment of the amount claimed in the sale notice and that no sale has taken place in pursuance of the sale notice, the learned Presiding Officer, DRT, Madurai is directed to dispose the afore said SA within a period of four weeks from the date of receipt of a copy of this order. Accordingly, this appeal is disposed. Parties shall bear their own costs. Pending IAs, if any shall stand closed.
