G.Ilangovan, J
The petitioner/Accused No.2, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 of IPC, in Crime No.206 of 2023, on the file of the respondent police, seek anticipatory bail.
The case of the prosecution is that the petitioner and other accused illegally transported 1 1/2 unit of vandal sand without proper license. Hence the complaint.
The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution.
The learned Government Advocate (Crl.side) would submit that the first accused was arrested on the spot. The petitioner is having two previous cases in similar nature.
Considering the facts and circumstances of this case and the previous cases of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. The petitioner is not entitled for any discretionary relief.
Accordingly, this Criminal Original Petition is dismissed.
