Re: Civil Misc. Review Application No. 101611 of 2009
This is an application filed by the applicant-Respondent for reviewing the order dated 30.3.2009 whereby on an interpretation of Clause 4.3. of the Agricultural Debt Waiver and Debt Relief Scheme, 2008, this Court has held that the loan disbursed to the Petitioner on 31.3.1997 would be covered under the scheme. Clause 4.3 of the scheme provides that ''nothing contained in the scheme shall apply to any loan disbursed by a lending institution prior to March 31, 1997.'' Since the loan was not disbursed to the Petitioner prior to 31.3.1997 but on 31.3.1997 itself, this Court by order dated 30.3.2009 had held that the case of the Petitioner would be covered under the scheme of the 2008.
Learned Counsel for the Respondent-Bank has however submitted that subsequently the Ministry of Finance has clarified the scheme to the effect that it will not apply to any loan disbursed on 31.3.1997.
Be that as it may, it is not the case of the Respondent-Bank that the scheme of the Central Government has been amended. The provision contained in paragraph 4.3 of the scheme still remains the same. Since the loan was not disbursed to the Petitioner prior to 31.3.1997, I do not find any good ground for reviewing the order dated 30.3.2009. In any case, since all these facts have been disclosed by the Petitioner in the writ petition itself, there is No. reason for the Court to consider the same arguments which were available to the review Petitioner at the stage when the order dated 30.3.2009 had been passed.
It is well settled legal proposition that the scope of review is very limited and an Order/Judgment can be reviewed only if it is established that it suffers from an error apparent on the face of the record or for any other sufficient reason. It is not an appeal in disguise. By means of review application, a litigant cannot get another occasion to re-address the Court again on merit. In the absence of any good ground for review, I am not inclined to allow this application.
This review application is, accordingly, rejected.
