Judgment

Heard Mr. N. Ibotombi, learned senior counsel assisted by Ms. Jenita, learned counsel appearing for the petitioner.
Issue notice, returnable within three weeks.
Mr. N. Nongdamba, learned counsel assisting Mr. Kh. Samarjit, learned DSGI entered appearance and accepts notice on behalf of the respondents, hence no formal notice is called for.
The present writ petition has been filed assailing the Advertisement dated 06-03-2023 notifying for recruitment of 54 (fifty four) posts of Nursing Officer in RIMS. The case of the petitioner is that under Section 34 of the Rights of Persons with Disabilities Act, 2016, it is mandated that not less than four percent of the total number of vacancies advertised for direct recruitment should be reserved for persons with benchmark disabilities. In the said impugned Advertisement, no such reservation has been made and as such, the said Advertisement is not sustainable in the eyes of law. The learned senior counsel, accordingly, prays for passing an interim order directing the respondents not to declare the result of the said recruitment process pursuant to the impugned advertisement.
Mr. Kh. Samarjit, learned DSGI appearing for the respondents seeks some time to file a detailed counter affidavit.
As prayed for, list these cases again on 29-02-2024. In the meantime, the respondents are directed not to declare the result of the recruitment process advertised for recruitment of Nursing Officers, pursuant to the impugned Advertisement dated 06-03-2023, without the leave of this court.
