Judgment
THIS is an appeal against the judgment passed by the District Forum, Tezpur, Sonitpur in Consumer Case No. 10/92, judgment dated 4.1.1993.
THE complainant herein was a subscriber in respect of the telephone. He made certain complaint to the authority regarding excessive billing on account of STD facility. For the period of one month i.e. from 18.4.1992 to 18.5.1992 the Department withdrew the STD facility for observation and to find out whether there was any misuse of telephone. THEreafter it was restored. This claim was filed for withdrawal of the STD facility for this period and the District Forum has awarded the compensation of Rs. 1,000/- with cost. Hence this appeal. We have heard Mr. K.N. Choudhury, learned Advocate for the appellant, none appeared for the respondent. The STD facility was withdrawn by the authority only to find out the truth regarding allegation and no fault can be found with the department and we also do not find that the withdrawal was for a long period but it was only for a month that also to find out the truth of allegation.
In that view of the matter, this appeal is allowed and the judgment passed by the District Forum shall stand quashed. Appeal allowed.
