Judgment

Mr. S. Sen, learned counsel for the petitioner has submitted that the urgency that is placed in this matter is the fact that this petition is slated to be finally heard on 19. 02. 2026. However, since the matter concerned the service condition of the petitioner particularly her claim for promotion to Lecturer (Selection Grade) and that she is due to retire on 28. 02. 2026, even if this Court decides in her favour, the department concerned will have to take necessary steps for constitution of Departmental Promotion Committee (DPC) which is likely to take some time, and in the meantime by a afflux of time the petitioner may lose her valuable rights. It is therefore prayed that this matter if not heard today may be taken up for hearing on the next date when the vacation bench sits, that is by preponing the date of hearing from 19.02. 2026.
Per contra, Mr. N.D. Chullai, learned AAG has submitted that there is no urgency in the matter as the conduct of the petitioner herself would shows that she has approached this Court belately and that considering the fact that her date of retirement would be 28. 02. 2026, therefore, the prayer to prepone the date of hearing may not be considered by this Court.
This Court upon hearing the learned counsel for the parties without going in to the merits of the case, however, being persuaded by the submission of the learned counsel for the petitioner would allow the prayer made.
Accordingly, this matter which is listed for hearing on the date fixed as 19. 02. 2026, is hereby modified to the extent that the next hearing date would be the next available vacation bench. List accordingly.
