Mohan Shantanagoudar, J.—The petitioner is the Law College run by a registered society called "Advocates Education Society", which is registered under the Karnataka Societies Registration Act, 1960. The College was established in the year 2004-05. After taking due approval of Bar Council of India and the affiliation of Bangalore University, the college was imparting legal education since 2004-05. However, the recognition granted by Bar Council of India came to be withdrawn on 12-3-2009 as is clear from Annexure-D, in much as the inspection wing of Bar Council of India found that the college did not have necessary infrastructure.

2.

Thereafter, the petitioner filed review petition praying for reconsideration of the decision taken by the Bar Council of India. The said review petition came to be dismissed as hot maintainable. Subsequently, the college filed one more application seeking approval extension of approval of affiliation for three years LL.B. Course and sent a demand draft for Rs. 1 lakh towards inspection charges. The Principal, Law College also requested the Bar Council of India to make arrangements to send the inspection team for inspection of Law College afresh, at the earliest. However, the team of Bar Council of India has not visited the Law College and inspected. According to the petitioner, the infrastructure of the Law College is upgraded.

3.

Sri Naik, learned Counsel appearing for the petitioner submits that if the inspection team of the Bar Council of India visits the college once again, it will satisfy itself about the infrastructure of the college. According to him, the concerned society has constructed a new building for Law College and now the Law College is housed in the new building, which has got necessary infrastructure. He further submits that the Law College is having other infrastructural facilities such as library, playground etc. Be that as it may, the question as to whether the Law College is having necessary infrastructure or not has to be determined by the Bar Council of India after inspecting the Law College. Therefore, suffice it to observe that the Bar Council of India shall conduct the inspection of the Law College at an early date. Accordingly, the following order is made:

Respondents 1 and 2 are directed to inspect the petitioner-Law College at an early date to satisfy itself about the infrastructure and thereafter shall proceed in accordance with law.

Writ petition is disposed of accordingly.
