Applicant is in judicial custody in Case Crime No.96 of 2024, under Sections 8/21(b)/29/60 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (“the Act”), Police Station Patel Nagar, District Dehradun. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, on 06.02.2024, 68 grams smack was allegedly recovered from the possession of the applicant.

It is the case of the applicant that the alleged recovered quantity is less than commercial; there is no independent witness to the recovery.

Learned State Counsel would submit that the applicant has been involved in 8 such cases in the past and in Case Crime No.2 of 2011, Police Station Kotwali, Vikas Nagar, District Dehradun, under the provisions of the Act, the applicant has been convicted by the court of Special Judge, NDPS Act, Dehradun.

List of the cases pending against the applicant has been given in the bail rejection order. Including the case of conviction, there are 7 more cases. The applicant is a convict, and, according to the FIR, has been involved in similar cases.

Having considered, this Court does not see any reason, which may entitle the applicant to bail. Accordingly, the bail application deserves to be rejected.

The bail application is rejected.
