Draft Issues have been filed on behalf of the parties. Heard the learned counsels appearing on behalf of the parties and perused the record of the case. Since the matter relates to recovery of outstanding dues, it was submitted on behalf of the Petitioner that Issues need to be settled in the instant matter though it is the Telecom Petition. In the light of the material available on record of the case, the following Issues are settled:
ISSUES
Whether the Respondent was availing the services as per the Master Service Agreement dated 02.02.2016 along with the Customer Order Form dated 30.06.2016 without any late and hindrances ?
Whether the Petitioner is entitled to a decree for the outstanding dues of Rs.24,98,356/- against the Invoices as per the Agreement ?
Whether the Petitioner is entitled to receive interest @ 18% p.a. on the above amount from the date it became due and payable till its actual realization ?
To what other relief / reliefs the Petitioner is entitled to ?
Four weeks time is prayed and allowed to the Petitioner to file their evidence affidavits. The Respondents may file their evidence affidavits within four weeks thereafter. Let the matter be listed for directions on 29th November, 2022.
