Judgment
Prafulla C. Pant, J.—Applicant-Tasir Ahmad @ Tamsan @ Taison, who is in jail in connection with F.I.R No. 46 of 2009 2 (S.T. No. 151 of 2009) relating to offences punishable u/s 147, 149, 435, 336, 427, 341, 353, 109, 114, 395, 120B I.P.C., Section 7 Criminal Law Amendment Act, and one punishable u/s 3 of Prevention of Damage to Public Property Act, police station Kaladhungi, District Nainital, has sought his release on bail.
Heard.
Applicant is not named in the First Information Report. It is a case of mob reaction to the murder of one Shri Balwant Singh Kanyal, Block Pramukh of the Area. No specific role is shown to the applicant. The applicant is in jail for about one and half years. It is also pleaded that the trial is going at a slow speed.
Having considered facts and circumstances of the case, without expressing any opinion as to the final merits of the case, this Court is of the view that the applicant deserves bail.
The Bail Application is allowed. Let the applicant-Tasir Ahmad @ Tamsan@ Taison, be released on bail on executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of Chief Judicial Magistrate, Nainital.
