Vide Order of this Court, dated 01-06-2023, the original document, Exhibit 2, the Certificate of Identification (COI) of the father of the Appellant had been called from the Court of Learned District Judge, Special Division – I, Gangtok, the document having been filed in Title Suit No.05 of 2010 (Tashi Dawa vs. Preetam Pradhan).

A communication, dated 03-06-2023, has been received from the Court Manager/Sheristadar Gr-I, District and Sessions Court, Gangtok, addressed to the Assistant Registrar (Judl) of this High Court, submitting therein that despite diligent efforts made by the Office of the District and Sessions Court, Special Division – I, the records could not be traced. Hence, they seek extension of time to locate the relevant file.

To assist in locating the document, Learned Counsel for both parties submit that the Eviction Suit No. 05 of 2010 (Tashi Dawa vs. Preetam Pradhan), was dismissed by the Judgment, dated 29-06-2013, of the Court of Learned District Judge, Special Division – I, Gangtok.

To do complete justice in the matter, I am of the considered opinion that it is imperative that the document be furnished before this Court. Accordingly, extension of time is allowed.

Let the document be furnished on or before 09-06-2023 without fail. Copy of this Order be sent to the Learned District Judge, Special Division – I, Gangtok, for information and compliance.
