Learned counsel for the Petitioner by claiming extreme urgency submitted before this Court that the Petitioners, who are residing in small hutments, had initially raised a grievance before the High Power Committee (HPC), however, their application was rejected; Against the order of HPC, the Petitioners have approached the Apex Grievance Redressal Committee - the appellate forum. Learned counsel also made an immediate attempt to seek interim protective orders from the appellate forum by approaching the said forum on Friday on receipt of notice of vacation / dispossession issued by SRA. It is then submitted by learned counsel for the Petitioners that it was informed to the Petitioners that no orders could be passed in the absence of formation and regular sitting of the Apex Committee and the Apex Committee would be available only on Friday, even for consideration of the request for interim orders. Learned counsel then submitted that if no interim orders are passed by this Court today, the Petitioners would face the action of dispossession or vacation of their premises and they would suffer an irreparable loss and great prejudice would be caused to them. In view of these submissions made by learned counsel for the Petitioner, the Respondent Authority - SRA and its officers are directed not to take any coercive steps pursuant to the notice issued on 20th October 2021 till 29th October 2021.
Learned AGP is called upon to make a statement before this Court as to whether the statement made before this Court that the appellate forum - the Apex Grievance Redressal Committee is available only on specific dates or whether the said appellate forum is expected to function regularly, i.e., on all working days.
Learned counsel for the petitioner undertakes to supply copy of the petition to all the respondents today itself. Learned counsel for the Petitioner is permitted to serve the authenticated copy of this order on all the respondents.
