Judgment
Hon’ble Shri Bibhu Datta Guru, Judge
This MCC is filed for restoration of WPS No. 6234/2026, which came to be dismissed for want of prosecution vide order dated 19.08.2026.
Learned counsel for the applicant submits that the aforesaid writ petition was listed for hearing before this Court. When the matter was called out, learned counsel appearing for the applicant could not appear before this Court as she was engaged in another matter before a different Court and, due to such unavoidable circumstances, could not remain present. Consequently, the writ petition came to be dismissed for want of prosecution.
It is further submitted that the non-appearance of learned counsel was neither intentional nor deliberate, but was due to unavoidable circumstances. The applicant has been diligently pursuing the writ petition and has no intention to abandon the proceedings. It is, therefore, prayed that WPS No. 6234/2026 be restored to its original number.
I have heard learned counsel for the applicant and perused the material available on record.
Considering the facts and circumstances of the case and the explanation furnished by the applicant, this Court is satisfied that sufficient cause has been shown for restoration of WPS No. 6234/2026. The non-appearance of learned counsel appears to be bona fide and inadvertent.
Accordingly, this MCC is allowed, subject to payment of costs of Rs. 2,000/- (Rupees Two Thousand only) by the applicant in the Chhattisgarh High Court Bar Association Library Fund.
Upon deposit of the aforesaid cost, the order dated 19.08.2026 whereby WPS No. 6234/2026 was dismissed for want of prosecution, shall stand recalled and WPS No. 6234/2026 shall be restored to its original number.
The MCC stands disposed of accordingly.
