This is an appeal from a decision of the District Judge of Birbhum, dismissing a suit for ejectment on the ground that notice had not been properly served. The mode of service is prescribed in the rules made by the Government under the Bengal Tenancy Act, and those rules state that when no special form of service (sic)is directed in the Act, service shall be effected by the Court in the manner provided in the CPC for the service of summonses.

That has not been done in this case, and we think that the Judge in the Court below came to a right conclusion. The appeal is dismissed with costs.
